1. Acceptance of Terms
By accessing or using the marketplace.pulpop.io website (hereinafter referred to as the "Marketplace"), you agree to comply with and be bound by these Terms and Conditions (hereinafter referred to as the "Terms"). If you do not agree to these Terms, you are not authorised to use the Marketplace.
2. Identification of the Operating Entity

3. Nature of the Sales Contract
Pulpop acts solely as an intermediary in transactions within the Marketplace. Products and services purchased through the platform are sold directly by external sellers. When making a purchase, the buyer enters into a direct sales contract with the respective seller. Pulpop does not own the products and is not responsible for their quality, delivery, or compliance.
Pulpop makes available to users, through commercial partners, the possibility of contracting logistics services. However, the contracting of these services is directly between the buyer or seller and the respective logistics company. Pulpop is exempt from any liability related to product loss, delivery delays, or any incident arising from transportation. Therefore, Pulpop allows sellers and buyers to choose their preferred shipping method.
4. Account Registration and Responsibilities
To use certain features of the Marketplace, users must register and provide truthful and up-to-date information. You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account.
5. Fees and Payments
Pulpop may charge fees for the listing of products and services, as well as commissions on transactions. All payments are processed through external providers. Pulpop is not responsible for any issues related to payment processing.
6. Prohibited Activities
Users are prohibited from engaging in activities that:
- Violate any applicable laws or regulations.
- Infringe intellectual property, privacy, or any third-party rights.
- Involve fraud, misleading advertising, or fraudulent transactions.
- Promote illegal or hazardous products.
- Use false information or impersonate others.
- Interfere with the functioning of the Marketplace or payment systems.
7. Compliance Monitoring and Controls
To ensure compliance with these Terms and the AUP, Pulpop implements the following controls:
- Verification of seller identity and documentation.
- Periodic review of listings to detect prohibited content.
- Monitoring of transactions to prevent fraud.
- Reporting mechanisms and assessment of violations.
- Suspension or termination of accounts that violate the Terms.
8. Applicable Law and Liability Exemption
Pulpop operates in accordance with the Law on Information Society Services and Electronic Commerce (LSSI), Article 16 of which states that intermediaries are not liable for third-party content as long as they are unaware of its unlawful nature and act diligently to remove it when informed.
Furthermore, Pulpop is covered by Directive (EU) 2024/2853, which establishes that online platforms acting solely as intermediaries between traders and consumers are exempt from direct liability for third-party products, provided they comply with the obligations set out in Regulation (EU) 2022/2065.
9. Dispute Resolution
In the event of disputes, parties are encouraged to resolve them amicably. Pulpop may offer mediation services but is not responsible for final resolution.
10. Limitation of Liability
Pulpop is not liable for any indirect, incidental, or consequential damages arising from the use of the Marketplace.
11. Changes to the Terms
Pulpop reserves the right to modify these Terms at any time. Continued use of the Marketplace following changes constitutes acceptance.
12. Governing Law
These Terms are governed by the laws of Spain and the applicable regulations of the European Union.
