1. Acceptance of Terms

By accessing or using the website marketplace.pulpop.io (hereinafter, the “Marketplace”), you agree to comply with and be bound by these Terms and Conditions (hereinafter, the “Terms”). If you do not agree with these Terms, you are not authorized to use the Marketplace.

2. Identification of the Operating Entity

3. Nature of the Sales Contract

Pulpop acts solely as an intermediary in transactions within the Marketplace. Products and services purchased through the platform are sold directly by external sellers. By making a purchase, the buyer enters into a sales contract directly with the respective seller. Pulpop does not own the products nor is it responsible for their quality, delivery, or compliance.

Pulpop makes it possible for users, through commercial partners, to arrange logistics services. However, these services are contracted directly between the buyer or seller and the respective logistics company. Pulpop is exempt from any liability related to product loss, delivery delays, or any issues arising from shipping. Therefore, Pulpop allows sellers and buyers to choose their preferred shipping method.

4. Registration and Account Responsibilities

To use certain features of the Marketplace, users must register and provide accurate, up-to-date information. You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account.

5. Fees and Payments

Pulpop may charge fees for listing products and services on the platform, as well as commissions for completed transactions. Commissions vary by plan and region, and are detailed on the following page: Check fees by plan and region . All payments are managed through third-party providers. Pulpop is not responsible for any issues arising from payment processing by these providers.

6. Prohibited Activities

Users are prohibited from performing activities that:

  • Violate any applicable law or regulation.
  • Infringe on intellectual property rights, privacy, or any third-party rights.
  • Involve fraud, deceptive advertising, or fraudulent transactions.
  • Commercialize illegal or dangerous products.
  • Use false information or impersonate others.
  • Interfere with the operation of the Marketplace or payment systems.

7. Compliance Monitoring and Controls

To ensure compliance with these Terms and the AUP, Pulpop implements the following measures:

  • Verification of seller identity and documentation.
  • Periodic review of listings to detect prohibited content.
  • Monitoring transactions to prevent fraud.
  • Reporting mechanisms and evaluation of breaches.
  • Suspension or removal of accounts that violate the Terms.

8. Applicable Law and Disclaimer of Liability

Pulpop acts in accordance with the Spanish Law on Information Society Services and E-commerce (LSSI) in its Article 16, which establishes that intermediary service providers are not liable for third-party information stored, provided they have no effective knowledge of its illegality and, if they do become aware, act diligently to remove it.

Likewise, Pulpop is covered by Directive (EU) 2024/2853, which states that online platforms acting solely as intermediaries in sales between merchants and consumers are exempt from direct liability for products offered by third parties, as long as they comply with the obligations set out in Regulation (EU) 2022/2065.

9. Dispute Resolution

In the event of disputes, the parties are encouraged to resolve them amicably. Pulpop may offer mediation services but is not responsible for the final resolution.

10. Limitation of Liability

Pulpop is not liable for indirect, incidental, or consequential damages arising from the use of the Marketplace.

11. Changes to the Terms

Pulpop reserves the right to modify these Terms at any time. Continued use of the Marketplace following such changes implies acceptance.

12. Governing Law

These Terms are governed by the laws of Spain and the applicable regulations of the European Union.
